Terms of Service

1. Agreement to Terms

By accessing or using The 12 Tribes™ platform operated by Hayden-Fisher Technologies, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the platform. These Terms apply to all visitors, users, and others who access or use the service.

2. Eligibility

You must be at least 13 years of age to use The 12 Tribes™. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the service. By using the platform, you represent and warrant that you meet these eligibility requirements.

3. Your Account

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your password and account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the service, other accounts, or computer systems.
• Use automated scripts, bots, or scrapers to access the service without our written permission.
• Interfere with or disrupt the service, servers, or networks connected to the service.
• Harass, abuse, or harm other users through in-game interactions or communications.
• Exploit bugs, glitches, or unintended game mechanics. Please report them to us instead.
• Create multiple accounts to circumvent bans, restrictions, or subscription limits.

5. Subscriptions & Payments

Certain features require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your chosen plan at the prices in effect at the time of purchase.
• Automatic renewal at the end of each billing period unless you cancel before the renewal date.
• Provide accurate and complete billing information.

All payments are processed securely through Stripe. We do not store your payment card details. You may cancel your subscription at any time from your Dashboard. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.

6. Intellectual Property

The 12 Tribes™ name, logo, card designs, game mechanics, artwork, and all associated content are the property of Hayden-Fisher Technologies, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the service for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the platform without our prior written consent.

7. User Content

When you create decks, share deck lists, or submit support requests, you retain ownership of the content you create. However, by sharing content publicly (e.g., public decks), you grant us a worldwide, royalty-free, non-exclusive license to display and distribute that content within the platform.

You represent that any content you submit does not violate the rights of any third party and complies with these Terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Game balance, card availability, and features may change at any time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAYDEN-FISHER TECHNOLOGIES, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users or the service, or for any other reason at our sole discretion.

You may delete your account at any time. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service shall be resolved in the state or federal courts located in Delaware.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated via email or a prominent notice on the platform. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
